This Privacy Policy of personal data (hereinafter — the “Privacy Policy”) applies to all information published on the website at festagent.com (hereinafter — the “Website”), as well as information provided by the Website Users while using the Website, its services, programs, and products, and transmitted to the Website owner, individual entrepreneur Ivan Andreevich Zolotukhin (TIN: 22212198550050, OKPO: 33960985) (hereinafter — the “Website Owner”).

Use of the Website and its services implies the User’s unconditional consent to this Privacy Policy (both in full and in part) and to the conditions for processing their personal information stated herein. If the User disagrees with these terms, they must refrain from using the Website services and leave the Website.

For the purposes of this Privacy Policy, a Website User is understood as a visitor who contacts the Website Owner via the communication channels specified on the Website or uses the services, programs, and/or products of the Website.

1.1. For the purposes of this Privacy Policy, the User’s personal information includes:

1.1.1. Personal information voluntarily provided by the User during registration (creating an account) or while contacting the Website Owner via the channels specified on the Website or using the services, programs, and/or products of the Website, including, but not limited to, the User’s surname, first name, patronymic, place of work, position, education, age, residential addresses, email address, and phone number.

1.1.2. Data automatically transmitted to the Website services and/or the Website Owner during use via software installed on the User’s device, including IP address, cookies, browser information (or other software used to access services), technical characteristics of equipment and software used by the User, date and time of access to services, requested page addresses, and other similar information.

1.1.3. Other information about the User voluntarily provided during use of the Website and/or when contacting the Website Owner via the channels specified on the Website.

1.1.4. This Privacy Policy applies only to the Website: festagent.com. The Website Owner does not control and is not responsible for third-party websites that the User may access through links available on festagent.com.

2.1. The Website and/or Website Owner collects and stores only the personal information necessary to provide services, fulfill agreements and contracts with the User, and conduct advertising campaigns by the Website Owner, except where legislation requires mandatory storage of personal information for a legally established period. The Website uses only the information necessary about the User.

2.2. The Website and/or Website Owner processes the User’s personal information for the following purposes:

2.2.1. Identifying the User who contacted the Website Owner, uses the Website services, and/or registered on the Website to conduct civil-law transactions with the Website Owner.

2.2.2. Providing the User access to personalized resources of the Website.

2.2.3. Establishing feedback with the User, including sending notifications and inquiries related to Website use, providing information about products/services/works listed on the Website to the User’s email address, processing requests and applications from the User, and making calls to the User’s phone number to conduct civil-law transactions.

2.2.5. Improving the quality of Website services and functions to provide better service to the User.

2.2.6. Developing new services and functions that may be useful to the User.

2.2.7. Resolving User issues related to payments.

3.1. The Website Owner and/or the Website stores Users’ personal information in accordance with internal regulations adopted by the Website Owner.

3.3. The Website and/or Website Owner may transfer Users’ personal information to third parties in the following cases:

3.3.1. The User has consented to such actions through transactions with the Website Owner or by other means.

3.7. The Website Owner and the User take all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User’s personal data.

3.10. The User is fully responsible for the accuracy of the personal information provided, including regarding legal capacity.

3.11. The User acknowledges all negative consequences of providing false or outdated information.

3.12. The User understands and agrees that some of the information they provide may be accessible to other Website Users — privacy settings can be adjusted in the Film Card settings.

4.1. The User must:

4.2. The Website Owner must:

4.2.1. Use the received information exclusively for purposes stated in this Privacy Policy.

4.2.2. Ensure the confidentiality of information, not disclose it without prior written permission from the User, and not sell, exchange, publish, or otherwise disclose the User’s personal data, except as provided in this Privacy Policy.

4.2.3. Take precautionary measures to protect Users’ personal data in accordance with commonly accepted business practices.

4.2.4. Block personal data related to the respective User upon request of the User or their legal representative or authorized body for the protection of personal data subjects, for the period of verification in case of false data or unlawful actions.

5.1. The Website Owner is liable for damages incurred by the User due to unlawful use of personal data in accordance with the legislation of the Kyrgyz Republic.

5.2. The Website Owner is not liable for loss or disclosure of confidential information if such information:

5.2.1. Became publicly available before its loss or disclosure.

5.2.2. Was received from a third party prior to obtaining it by the Website Owner.

5.2.3. Was disclosed with the User’s consent.

6.1. Prior to filing a lawsuit for disputes arising between the Website User and the Website Owner, the User must submit a claim (written proposal for voluntary dispute resolution).

6.2. The recipient of the claim shall notify the claimant of the results in writing within 30 calendar days of receiving the claim.

6.3. If no agreement is reached, the dispute will be submitted to court in accordance with the current legislation of the Kyrgyz Republic.

6.4. This Privacy Policy and relations between the User and the Website Owner are governed by the current legislation of the Kyrgyz Republic.

7.1. The Website Owner may amend this Privacy Policy without the User’s consent, indicating the effective date of the new version.

7.2. The new Privacy Policy comes into effect upon its publication on the Website, unless otherwise specified.

7.3. LLC “Freedom Pay Kyrgyzstan”, providing payment services to the Website Owner, protects and processes bank card data according to the PCI DSS security standard. Information transmission to the payment gateway is encrypted using SSL technology.

7.4. Personal information provided by the User when making payments on the Website is confidential and not disclosed. Bank card data are transmitted only in encrypted form and are not stored on the Website. Payment security is guaranteed by LLC “Freedom Pay Kyrgyzstan”. All card transactions comply with Visa International and MasterCard Worldwide requirements.
